  • Chaperones will be responsible for a group of children from check-in to check-out. Chaperones must stay until all children in their group have been checked out to a designated parent/guardian. Liability Waiver

I agree that I am at least 19 years of age or the parent/guardian of an entrant that is 18 years of age or younger and I hereby submit this application for registration in the 2024 Advanced Training Retreat hosted by Birmingham Academy of Martial Arts.

I understand that all activities will take place in an area that includes over 1,000 acres of forests, meadows, streams and canyons. and that during the retreat I, the student/parent, will participate in physical and hazardous activities that take place in the wilderness and outdoor camp environment, including without limitation, swimming; canoeing; hiking over rough terrain or in the vicinity of water; and challenge or ropes course activities such as climbing, jumping, balancing, and being lifted or supported by a rope and harness system at heights up to thirty feet in the air.

I agree to waive all claims against any and all persons, Birmingham Academy of Martial Arts Inc., Camp McDowell, my school, and their officers and agents, for any injuries I may sustain related to said camp. I also assume full responsibility for all my actions in connection with said camp. I understand that B.M.A. may use any pictures of me participating in said camp without my permission. I also understand there are no refunds after the registration deadline date.

I, the student/parent, acknowledge the existence of certain inherent risks in this type of training and hereby agree to assume all risks. I further relieve the school and, its management, assigned staff, fellow students and, if applicable, my cover school, its management, assigned staff and fellow students from any liability resulting from loss whether personal belongings or bodily injury.

I, the student/parent, hereby forever release and discharge Birmingham Academy of Martial Arts, its management, assigned staff, fellow students and, if applicable, my cover school, its management, assigned staff and fellow students from any and all liabilities, claims, demands, or causes of action that I may hereafter have for injuries and damages arising out of or connected in any way to COVID-19 or any of Birmingham Academy of Martial Arts' services, including, but not limited to, losses caused by the passive or active negligence of Birmingham Academy of Martial Arts or hidden, latent, or obvious risks of live Martial Arts training during a pandemic.

I, the student/parent, further assume all risks of bodily injury, accidents, illness, disability, death, loss of or damage to personal property and expenses as a result of or connected in any way to live Martial Arts training during a pandemic.

I, the student/parent, understand that if I, or any member of my family is showing symptoms of COVID-19, I am being asked to leave or stay home.

I, the undersigned, understand and agree that participating in any Program inherently involves risks, hazards, and dangers, including but not limited to the risks of falling, falling rocks or objects, fractures, concussions, dangerous weather, overexertion, overheating, injuries caused by a lack of fitness or conditioning, infectious disease, river currents, hypothermia, hostile or aggressive farm animals or wildlife, equipment failures, negligence of others, accident, injury, death, mental or emotional trauma, disability, and property damage or loss. In consideration for my being permitted to participate in a Program, I, for myself (and for my child if participant is under 19), my heirs, assigns, and personal representatives, hereby knowingly and intentionally agree to assume all risks of participating in any Program and forever release and hold harmless Camp McDowell and the Episcopal Diocese of Alabama, as well as their employees, agents, directors, volunteers, participants, guests, representatives, affiliates, and all other persons or entities acting under their direction and control (“Released Parties”) from any and all liability, claims, actions, losses, and demands arising out of or relating in any way to my participation in any Program, including but not limited to those arising from travel to and from the program site or from the negligence of the Released Parties.

By signing this form I am certifying that I am capable of—and have not been advised by a medical professional to refrain from—participating in these and similar physical activities. I also consent to receive (or, if applicable, have my child receive) medical treatment that may be deemed advisable in the event of injury, accident, or illness during any Program.

This agreement is governed by and shall be construed in accordance with the laws of the state of Alabama, without any reference to its choice of law rules. I agree that any dispute arising from this agreement or in any way associated with a Program shall be brought only in the state or federal courts of Jefferson County, Alabama, and I agree to the jurisdiction and venue of those courts for any such dispute.

I HAVE CAREFULLY READ, FULLY UNDERSTAND, AND VOLUNTARILY SIGN THIS WAIVER OF LIABILTY AND RELEASE ON BEHALF OF MYSELF AND, IF APPLICABLE, AS THE PARENT OR LEGAL GUARIAN OF A PARTICIPANT UNDER THE AGE OF 19 YEARS. I ACCEPT THE TERMS AND CONDITIONS STATED HEREIN AND ACKNOWLEDGE THAT THIS AGREEMENT SHALL BE BINDING UPON ME, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVE, AND ESTATE, AND ALL MEMBERS OF MY FAMILY INCLUDING ANY MINORS ACCOMPANYING ME.



Emergency Information

Medical Waiver

I hereby give my permission for the staff of Camp McDowell and/or Birmingham Academy of Martial Arts to seek emergency medical attention for the above named person.

I hereby give my permission for the staff of Camp McDowell and/or Birmingham Academy of Martial Arts to administer any over-the-counter medication for the above named person on an as needed basis or prescription medication as indicated by clear instructions printed on the medication container.
I, the undersigned, for myself, my heirs, executors and administrators, do hereby waive, release and forever discharge any and all rights and claims for damages which I may have for officers or representatives of Birmingham Academy of Martial Arts, successors, Camp Staff, for any and all damages which may be sustained by me.

Must be signed by a parent or guardian if entrant is under 19.
